12. What will happen at any further hearings?

Both parties must attend any further hearings. If the Claimant is absent, then the Tribunal may strike out the claim. If the Defendant is absent but has been served with the claim, then judgment may be entered if the Claimant can prove the case.

The Presiding Officer will

  • hear each party's case;

  • allow the Claimant and the Defendant to question each other and their witnesses;
  • order the parties to provide further evidence or to call further witnesses and adjourn the hearing to a later date;
  • deliver judgment at the end of the hearing or fix a date to deliver judgment.
