An award for compensation may be proportionately reduced by payments that are made under insurance coverage.

Alternatively, the insurance company which has previously admitted and paid the claims that are covered under your insurance policy may take over all your rights and claims against the defendant in the legal proceedings. In this case, compensation that is awarded by the Court is collected by the insurance company. If the amount that is awarded by the Court is greater than the amount that is paid by the insurance company, the company will refund the surplus to you. The rationale is that the plaintiff should be prevented from making a profit from the court proceedings and the insurance coverage.
