Yes, an employee can simultaneously make 2 separate claims, one for employees' compensation (for work-related injuries), and the other for compensation under personal injuries. When the two actions are against the same party, however, the award in one lawsuit may be offset by the award given in the other. For example, if the plaintiff has been awarded $500,000 as compensation under the personal injury proceedings and $200,000 under the employees' compensation proceedings, the final award to the plaintiff under the personal injury proceedings would only be $300,000 (i.e. $500,000 - $200,000).
