Yes, a personal injury claim can be made against a person for criminal assault. The Court, in the relevant criminal case, may also order the defendant to pay compensation to the plaintiff. In this case, the amount of compensation to be received from the personal injury claim may be reduced accordingly.
If the defendant has no money to pay compensation under a personal injury claim, the plaintiff may choose to commence bankruptcy proceedings against the defendant, though it is unlikely that the amount recoverable will justify the legal expense.
