3. I was injured by a restaurant waiter who carelessly spilled hot soup on me.  Should I sue the waiter and the restaurant owner and claim compensation from both of them?

In many personal injury cases, there may be more than one potential defendant depending on the inter-relationship among the parties and the circumstances of the accident.  In this scenario, it would be advisable for the claimant to commence proceedings against the waiter and the employer of the waiter. Generally, the employer would be vicariously liable for a negligent act of the waiter that was performed in the course of the waiter’s normal employment duties.

You are advised to consult a lawyer before deciding on the appropriate parties to sue.
