10. Can contractual terms override the statutory exemptions to copyright infringement?

There is no express provision in the Copyright Ordinance that restricts parties from using a contract to override the statutory copyright exceptions. Section 37(1) of the Copyright Ordinance provides that statutory copyright exceptions relate only to the question of copyright infringement and as such do not affect any other right or obligation restricting the doing of any of the specified acts (e,g, the contractual arrangements agreed between individual parties).
