3. Notifiable workplace and prohibition notices

Under section 2 of the Ordinance, notifiable workplace means any factory, mine or quarry and any premises or place in which a dangerous trade or schedule trade is carried on or is proposed to be carried on.

 

Under section 9A(1) of the Ordinance, if the Commissioner for Labour considers that any notifiable workplace is not suitable for use as a factory, mine or quarry or for the carrying on of any dangerous trade or any industrial process, he may issue to the proprietor a prohibition notice to prohibit the use or the activities. Reasons for issuing the notice and a date by which compliance is required shall be stated on the notice.
