17. I have bought a lawful copy of a musical CD. Will I infringe the copyright if I convert it into MP3 format so that I can play it on a MP3 player?

The law was changed on 1 May 2023 to allow for copying of sound recordings for private and domestic use (see section 76A of the Copyright Ordinance).  You will not infringe the copyright if the following conditions are satisfied:-

 

  • the original copy (i.e. the musical CD you bought) is not an infringing copy;
  • the private copy which you make is solely for the private and domestic use by yourself or a member of the household in which you live;
  • not more than one private copy of the original copy is made and stored in each device lawfully owned by you; and
  • you retain the ownership of both the original copy and the private copy.
